By using the timeiq.com website ("Service") and all services of Time IQ LLC ("Time IQ") you ("Customer") agree to be bound by the following terms and conditions ("Terms of Service").

Time IQ reserves the right to modify the Terms of Service at any time without notice and you agree to be bound by such modifications. If you do not accept and abide by this Agreement, you may not use the Time IQ Service.

Violation of any of the terms below will result in the termination of your Account. You agree to use the Service at your own risk.

Description Of Service

Time IQ is a web based service for the tracking of time within companies, groups, and organizations. You understand and agree that the Service is provided on an AS-IS and AS-AVAILABLE basis. Time IQ disclaims all responsibility and liability for the availability, timeliness, security, or reliability of the Service. Time IQ reserves the right to modify, suspend or discontinue the Service with or without notice at any time and without any liability to you.

General

1. Use of the Service is at your own risk. The Service is provided as-is and on an as available basis.
2. Time IQ does not warrant that the Service will be uninterrupted, timely, secure, or error-free, that the results obtained from the use of the Service will be accurate or reliable, that the quality of the Service will meet your expectations, or that any errors in the Service will be corrected.
3. Support is only available to paying customers and only available through email: support@timeiq.com.
4. You must not reverse engineer or otherwise attempt to hack the Service.
5. The unauthorized access of other member accounts is prohibited and immediate grounds for account termination.
6. You may not make any attempts to copy the service, resell the service, or claim any direct affiliation with Time IQ.
7. You understand that the transmission of the Service and your data may be unencrypted and involve transmission over various networks in its delivery to you.
8. You understand that the service may not meet your specific needs and may have deficiencies that make it unusable to your company or organization.

Proper Use

1. You must be 13 years or older to use this Service.
2. The Service may only be used by you, persons employed by your company or organization, and agents of your company or organization.
3. Each employee must be assigned his/her own unique login. The sharing of login credentials to avoid upgrading to the proper plan is not permitted.
4. You may not use the Service for any illegal purpose. You must not violate any laws in your jurisdiction when using the Service.
5. Time IQ reserves the right to refuse service to anyone for any reason at any time.
6. Time IQ accounts are limited to reasonable usages of bandwidth on a monthly basis. "Reasonable" is to be defined at the sole discretion of Time IQ and may change at any time. Accounts using more than 500 Megabytes of data transfer monthly may be assessed additional high-bandwith surcharges appropriate for the excess usage. No customers will be assessed any additional charges to their accounts without first being contacted via email and confirming the additional fees. Customers unwilling to agree to additional usage fees will have their accounts suspended or deleted.

Content Ownership & Confidentiality

1. You are responsible for the content of your Time IQ account. At no time shall you violate any copyright laws in using the Service.
2. Time IQ understands that you will be storing sensitive information in the form of client lists, contact information, and financial information such as project time. Time IQ will not use your client data for our own business advantage. We will not use your data to contact your clientele, market to them, or profit from them in any way.

Payment, Refunds, Upgrading and Downgrading

1. All Accounts require a valid credit card for activation.
2. Accounts who are elligible for a free 30-day trial will not be billed until 30 days following the activation of their account.
3. Customers Upgrading or Downgrading during a 30-day trial, or from a free account, will be charged immediately upon changing their plan.
4. The Service is billed in advance on a monthly basis and is non-refundable once your account has been charged. There are no refunds or credits for partial months of service, account downgrade refunds, or refunds for months unused with an open account. No exceptions will be made.
5. Upgrades or Downgrades will take effect immediately and the new rates will take effect at the beginning of your next billing cycle.
6. Service may not be downgraded when the number of active employees exceeds the allowed ammount in the selected plan.
7. All advertised fees are exclusive of advertised taxes. Time IQ is a registered Wisconsin business and will collect sales use tax for customers based in Wisconsin. You are responsible for payment of any applicable taxes, levies, or duties in your area that apply to you that are not collected by Time IQ.

Cancellation

1. You are able to cancel your account at any time by clicking on the Account link in the main navigation bar of your Time IQ interface. The Account page provides a cancellation button that will allow you to immediately close your account. It is your responsibility to close your account at any time you wish to terminate Service.

Termination

1. Time IQ reserves the right to suspend or terminate your account for any reason at any time. Such termination of the Service may result in the deletion of your account, revocation of access to your account, and the removal of all Data in your account.

Waiver of any of these terms does not constitute a waiver of that right by Time IQ. This document supersedes all other agreements and may be updated at any time.
